These Terms of Service (“Terms”) govern your use of the Mugen Anime website (mugenanime.co.nz) and any purchase you make from us. Mugen Anime is a brand operated by RRP Trading Limited (“we”, “us”, “our”). By accessing or using our website, or placing an order, you agree to these Terms. Please read them carefully.

Part A applies to everyone who uses our website. Part B applies when you purchase goods from us. Our Privacy Policy and Returns & Refunds Policy also form part of these Terms.

PART A — WEBSITE TERMS OF USE

1. Use of our website

You may use our website for lawful purposes only. You agree not to:

• Use the site in any way that breaches any applicable law or regulation.

• Attempt to gain unauthorised access to our website, servers, or any connected systems.

• Introduce viruses, malware, or other harmful material.

• Use the site to transmit unsolicited or unauthorised advertising.

• Copy, scrape, or harvest content or data from the site without our permission.

2. Intellectual property

• The content of this website — including text, original images, logos, layout, and design — is owned by or licensed to us and is protected by intellectual property laws.

• You may view and print content for your own personal, non-commercial use only.

• Third-party brands, trademarks, and character designs shown on the site remain the property of their respective owners.

• We take care to ensure the information on our website is accurate, but we do not warrant that it is complete, current, or error-free.

6. User submissions and reviews

Our website may allow you to submit product reviews, ratings, comments, or other content (“submissions”). By making a submission, you agree that:

• Your submission is your own, is accurate, and does not breach any law or any other person’s rights (including copyright, trademark, privacy, or confidentiality).

• Your submission does not contain anything unlawful, misleading, defamatory, abusive, obscene, or harmful, and does not contain viruses or malicious code.

• You will not impersonate any person or misrepresent your identity or connection with any person.

You grant us a non-exclusive, royalty-free licence to use, publish, edit, and display your submission in connection with our business. We are not obliged to publish, keep, or pay for any submission, and we may remove or decline to publish any submission at our discretion. We do not endorse, and are not responsible for, the content of any submission, and you are solely responsible for the submissions you make.

PART B — TERMS OF SALE

7. Our products

• We sell anime merchandise, including figures, Gunpla, trading cards, card accessories, and related collectibles. Most items are new; some are clearly described as pre-loved.

• Product images are provided as a guide. Colours and finishes may vary slightly due to manufacturing, photography, and screen settings.

• Pre-loved or built/painted items are sold in the condition described in the listing. Please read condition notes carefully before purchasing.

8. Pricing and GST

• All prices are listed in New Zealand Dollars (NZD) and include GST where applicable.

• Prices are subject to change without notice, but changes will not affect orders we have already accepted.

• Shipping costs (if any) are shown at checkout before you complete your order.

9. Orders and acceptance

When you place an order, you are making an offer to purchase. Your order is not accepted until we confirm it and dispatch the goods. We may decline or cancel an order at our discretion, including where:

• An item is out of stock or no longer available.

• There has been a pricing or product description error.

• We are unable to verify your payment or delivery details.

• We suspect fraudulent or unauthorised activity.

If we cancel an order you have already paid for, we will refund you in full.

10. Payment

• Payment is required in full at the time of ordering, unless otherwise agreed in writing.

• We accept the payment methods shown at checkout. Payments are processed securely by our third-party payment providers.

• Ownership of goods passes to you once we have received full payment and dispatched the goods.

11. Stock availability

All orders are subject to availability. Occasionally an item may sell out or become unavailable after you order. If this happens, we will contact you and offer a replacement, backorder, or full refund.

12. Pre-orders (if offered)

• Some items may be offered as pre-orders ahead of their release. Estimated release dates are provided by manufacturers and may change.

• Pre-order timeframes are estimates only and are not guaranteed.

• We will keep you informed of any significant delays and will offer a refund if an item is cancelled by the manufacturer.

13. Personal Shopping (Shikigami Service)

Our Shikigami service lets you ask us to purchase an item on your behalf from a third-party seller (for example, a store in Japan) and bring it back to New Zealand for you.

Service fee

In addition to the item price, a service fee applies:

• Orders under $100 NZD: a flat fee of $15 NZD.

• Orders $100 NZD and over: 20% of the total item cost, where “total item cost” means the item’s retail price (including any overseas tax) plus currency conversion fees.

Other terms

• Shipping: If the item can be hand-carried in our luggage, no additional shipping fee applies. If an item is too large or heavy to hand-carry, we will quote any shipping cost to you for approval before purchasing.

• Payment: The estimated item cost and service fee are payable upfront before we source the item.

• Price changes at source: Overseas prices and exchange rates can change. If the item’s price at the source increases between your order and our purchase, you are responsible for the difference. We will contact you before proceeding if the increase is significant.

• If we cannot source the item: If we are unable to purchase the item for you after you have paid, you will receive a full refund, including the service fee.

• Change of mind after purchase: Because this service involves us buying a specific item for you, the service fee is non-refundable once we have purchased the item on your behalf.

• Timeframes: Sourcing depends on our travel and the availability of the item at the source. Timeframes are estimates only and are not guaranteed.

• Condition and suitability: Items sourced through this service are supplied by third-party sellers. We take reasonable care in sourcing and handling, but we are not the manufacturer or original retailer. Please provide clear details of the item you want, as we purchase based on the information you give us.

• Customs and duties: Any New Zealand Customs duties, GST, or charges that apply on import will be passed on to you where applicable.

14. Delivery

Delivery is covered in our Shipping & Delivery Policy, which forms part of these Terms. We currently ship within New Zealand only.

15. Returns, refunds and your consumer rights

Your rights are covered in our Returns & Refunds Policy, which forms part of these Terms. Nothing in these Terms limits or excludes your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where they apply.

PART C — GENERAL TERMS

16. Limitation of liability

To the maximum extent permitted by law, and without limiting your rights under the Consumer Guarantees Act 1993:

• Our total liability for any claim relating to an order is limited to the price you paid for the relevant goods.

• We are not liable for any indirect, incidental, or consequential loss, or for any loss arising from your use of, or inability to use, our website.

Where you acquire goods for the purposes of a business, the parties agree that the Consumer Guarantees Act 1993 does not apply, to the extent permitted by law.

17. Indemnification

You agree to indemnify us against any reasonable loss, cost, or liability we incur arising directly from your breach of these Terms, your misuse of our website, or your breach of any law or any third party’s rights. This clause does not apply to the extent the loss is caused by our own negligence or breach, and nothing in it limits your rights under the Consumer Guarantees Act 1993 or Fair Trading Act 1986 where they apply.

18. Privacy

Your use of our website and your purchases are also governed by our Privacy Policy, which explains how we collect and handle your personal information, including our use of cookies.

19. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.

20. Entire agreement and waiver

• These Terms, together with our Privacy Policy, Returns & Refunds Policy, and Shipping & Delivery Policy, make up the entire agreement between you and us regarding your use of our website and your purchases.

• If we do not enforce a right or provision under these Terms, that is not a waiver of that right or provision.

21. Governing law

These Terms are governed by the laws of New Zealand, and any disputes will be subject to the jurisdiction of the New Zealand courts.

22. Changes to these Terms

We may update these Terms from time to time. The current version will always be available on our website, with the effective date shown at the top. For purchases, the version that applies is the one published at the time you place your order.
